Private & Personal Commission Terms of Service
Last Updated: [10/07/2026]
These Terms of Service apply to private and personal art commissions purchased directly from me. By placing an order, submitting payment, or otherwise beginning a commission, you confirm that you have read, understood, and agreed to these terms.
These terms apply to personal-use commissions only. Commercial commissions, professional branding, merchandise, advertising, publishing, and other commercial uses require a separate agreement and may have different pricing and licensing terms.
1. Commission Services
I currently offer private and personal commissions including:
-
Character portraits and busts
-
Full-body character artwork
-
Illustrated logos for personal projects
-
Fantasy and original character artwork
-
Fan art
-
Horror and dark-themed artwork
-
Mature-themed artwork
I reserve the right to decline a commission request for any reason, including requests that fall outside my artistic services, abilities, or personal boundaries.
2. Pricing and Payment
Commission prices are listed on my commission page and may vary depending on the service, complexity, and requested additions.
Unless otherwise agreed:
-
A 50% deposit is required before work begins.
-
The remaining 50% balance is due before the final artwork is delivered.
-
Additional charges may apply for requested add-ons, additional characters, complex backgrounds, significant revisions, or changes to the original scope of the commission.
-
Work will not begin until the required deposit has been received.
-
Final files will not be delivered until the commission has been paid in full.
Accepted payment methods: [PayPal / Stripe / Venmo / Zelle / etc.]
If a requested project changes significantly after the commission has been approved, I may pause work and provide an updated quote. Any changes to the scope, pricing, or deliverables will be discussed and agreed upon before additional work continues.
3. Commission Process
After payment is received, I will begin work according to the commission description and agreed scope.
The process may include sketches, drafts, or other progress images depending on the type of commission.
Clients are responsible for providing accurate reference materials and instructions before work begins. If important information is missing or changes after the commission has started, additional time or fees may apply.
I will make reasonable efforts to communicate about the progress of the commission and any issues that may affect the agreed scope or estimated completion date.
4. Revisions
Each commission includes two rounds of revisions.
Revisions are intended for reasonable changes to the existing artwork, such as adjustments to colors, details, expressions, clothing, or other minor changes.
A revision does not mean restarting the commission or substantially changing the original concept.
Requests for major changes after approval of the initial concept, additional revisions beyond the two included rounds, or changes caused by inaccurate or incomplete reference material may require an additional fee.
I will communicate any additional costs before completing the requested changes.
5. Turnaround Time
Each commission will have an estimated completion window based on the type and complexity of the project, my current workload, and any agreed-upon deadline.
Estimated completion dates are not guaranteed delivery dates unless a specific deadline has been agreed upon in writing.
Unexpected circumstances, scheduling changes, illness, or other circumstances may occasionally affect turnaround time. If a significant delay occurs, I will communicate with the client and provide an updated estimate.
Clients are also responsible for responding to requests for information, approvals, or revisions in a timely manner. Delays in client communication may extend the estimated completion time.
6. Cancellations and Refunds
Once work has begun, payments are nonrefundable to the extent permitted by applicable law.
If a commission is cancelled before work begins, the deposit may be refunded according to the circumstances and any applicable payment platform or legal requirements.
If a commission is cancelled after work has begun, the amount retained may reflect work already completed.
If I am unable to complete a commission, I will communicate with the client and provide an appropriate resolution, which may include a partial or full refund depending on how much work has been completed.
7. Scope Changes and Renegotiation
The original commission price is based on the agreed description, complexity, number of characters, deliverables, and intended use.
If the scope of the project changes substantially after work begins, the commission may need to be renegotiated.
Examples include:
-
Adding characters
-
Adding or significantly expanding a background
-
Changing the composition substantially
-
Requesting additional artwork
-
Requesting additional revisions beyond those included
-
Changing the intended use of the artwork
-
Requesting commercial rights
I will communicate any changes in pricing or terms before proceeding with additional work.
The client may decline the revised scope, in which case the commission will proceed according to the original agreement where reasonably possible.
8. Personal Use and Licensing
All commissions covered by these terms are provided for personal, non-commercial use only.
Personal use may include things such as:
-
Personal social media profiles
-
Personal websites
-
Personal avatars or profile images
-
Personal wallpapers
-
Printing artwork for personal display
-
Personal gifts
-
Personal, non-commercial creative projects
Purchasing a commission does not transfer copyright or ownership of the original artwork to the client.
I retain the copyright to the artwork unless a separate written agreement states otherwise.
The client receives permission to use the completed artwork for personal, non-commercial purposes only.
The artwork may not be used to generate income, promote a commercial business, advertise products or services, or otherwise support a commercial venture without a separate commercial-use agreement.
9. Commercial Use
Commercial use is not included with private or personal commissions.
Commercial use includes, but is not limited to:
-
Merchandise
-
Product packaging
-
Advertising
-
Business branding
-
Paid promotional material
-
Publishing
-
Crowdfunding campaigns
-
Monetized content
-
Products for sale
-
Commercial websites or marketing
-
Use by a business, organization, or company
Commercial projects require a separate agreement and may involve additional fees for licensing, usage, exclusivity, or copyright transfer.
If you are unsure whether your intended use qualifies as commercial, please ask before placing an order.
10. Illustrated Logos
Illustrated logos commissioned through this service are intended for personal, non-commercial projects unless otherwise agreed in writing.
For example, a personal logo for a hobby project, personal website, character, or private creative project may qualify as personal use.
A logo intended for a business, product, commercial publication, monetized project, company, or other commercial venture requires a separate commercial agreement.
Purchasing an illustrated logo does not automatically transfer copyright, trademark rights, or exclusive ownership of the artwork.
11. AI and Machine Learning Restrictions
My artwork may not be submitted to, uploaded to, or used for training, fine-tuning, testing, or developing artificial intelligence or machine-learning systems without my explicit written permission.
Clients may not use AI image-generation or image-editing tools to alter, extend, transform, or otherwise create derivative versions of commissioned artwork.
Commissioned artwork may not be used as a prompt reference, training image, dataset contribution, or input for an AI-generated image.
Normal non-AI adjustments for personal use, such as cropping, resizing, or preparing a file for printing, are permitted.
12. Resale, Redistribution, and Tokenization
Commissioned artwork may not be:
-
Resold
-
Licensed to another person or company
-
Redistributed as a standalone digital file
-
Used as a stock image
-
Uploaded to a marketplace for resale
-
Included in a paid asset pack
-
Minted or sold as an NFT
-
Tokenized or otherwise sold as a digital asset
-
Used to create derivative products for sale
Physical prints or products intended for resale require a separate commercial agreement.
13. Portfolio and Promotional Use
I retain the right to display completed commissioned artwork in my portfolio, on my website, and on my social media accounts.
This may include using the artwork to promote my commission services, participate in exhibitions, or otherwise showcase my work as an artist.
If you have a specific reason why a commission should not be publicly displayed, please discuss this with me before the commission begins. Private or delayed portfolio use may be possible depending on the circumstances.
14. Fan Art and Copyrighted Characters
I may accept fan art commissions involving existing fictional characters, depending on the project.
Fan art remains subject to the rights of the original copyright or trademark owners. Purchasing a fan art commission does not grant the client ownership of the underlying character, property, or franchise.
Fan art commissions are for personal use only unless otherwise agreed.
15. Client-Provided Materials
Clients are responsible for ensuring that they have the right to provide any reference images, logos, photographs, or other materials used for the commission.
By providing reference material, the client confirms that they have permission to use and provide that material for the purpose of creating the commission.
I am not responsible for copyright or other intellectual property disputes arising from materials supplied by the client.
16. Physical Products and Shipping
Physical products may be available for certain commissions depending on the project.
Shipping costs, production costs, and other physical fulfillment expenses may be charged separately.
The client is responsible for providing an accurate shipping address and other required delivery information.
Once a physical item has been shipped, delivery times and conditions are subject to the shipping provider.
17. Final Files
Digital commissions will be delivered in the file format and resolution appropriate for the agreed-upon use.
Unless otherwise agreed, delivery of the final artwork does not include source files, layered working files, sketches, or other production files.
Source files may be available separately by request and may require an additional fee.
18. Communication
Please provide accurate contact information when placing your order.
I will use the contact information provided to communicate about the commission, including progress updates, questions, approvals, and payment.
If I am unable to reach you for an extended period of time, the commission may be paused until communication resumes.
19. Agreement to Terms
By submitting a commission request or payment, you confirm that you have read and agreed to these Terms of Service.
If you have questions about these terms or are unsure whether your intended use qualifies as personal or commercial, please contact me before placing your order.
I reserve the right to update these Terms of Service for future commissions. The terms in effect at the time a commission is accepted will apply to that commission unless otherwise agreed in writing.
